TERMS OF PURCHASE

These Terms of Purchase and any separate agreements whereby we provide you with products or services shall, to the extent permitted by applicable law, be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region of the People's Republic of China.

These Terms of Purchase (“Terms of Purchase”) govern your purchases of products and services available through http://www.myfathbstore.com (the “Company Sites” or the “Sites”).

Your use of the Company Sites and these Terms of Purchase are also governed by the Terms of Use and Privacy Notice, which are incorporated herein by reference.

PLEASE CAREFULLY READ THESE TERMS OF PURCHASE, ALONG WITH THE TERMS OF USE, PRIVACY NOTICE, AND OTHER POLICIES OR AGREEMENTS REFERENCED IN THESE TERMS OF PURCHASE, BEFORE PURCHASING OR USING PRODUCTS OR SERVICES THROUGH THE COMPANY SITES.

BY PURCHASING OR USING PRODUCTS OR SERVICES THROUGH THE COMPANY SITES, YOU AGREE TO THESE TERMS OF PURCHASE, INCLUDING, WITHOUT LIMITATION, ANY APPLICABLE DISPUTE RESOLUTION PROVISIONS AND CLASS ACTION WAIVER DESCRIBED IN THE DISPUTE RESOLUTION SECTION BELOW.

GENERAL

These Terms of Purchase constitute a valid and binding agreement between you and the Company, enforceable in accordance with their terms, subject to applicable law.

You represent that you are:

at least 18 years of age;
of legal age to form a binding contract; and
not a person barred from receiving services under any applicable laws, rules, or regulations.

You shall purchase and use the products and services available through the Company Sites in compliance with these Terms of Purchase and all applicable laws, rules, and regulations (collectively, “Laws”).

You are responsible for complying with all applicable laws with respect to your purchase, including applicable laws in the jurisdiction to which any products are shipped.

Calls, emails, and other communications between you and the Company may be recorded where permitted by applicable law.

You acknowledge that personal information we obtain about you, whether through the Company Sites, by email, telephone, or other means, may be collected, stored, used, transferred, and otherwise processed in accordance with our Privacy Notice and applicable law.

The Company may update its Privacy Notice from time to time. Any changes to our Privacy Notice will be posted on the Company Sites.

Your continued use of the Sites after changes become effective will be subject to the updated Privacy Notice, to the extent permitted by applicable law.

PURCHASES

Order Processing

The Company may, in its sole discretion, choose not to process or may cancel your order in certain circumstances.

This may occur, for example, when the product or service you wish to purchase is out of stock, has been mispriced, we reasonably suspect that the order is fraudulent, or in other circumstances permitted by applicable law.

The Company also reserves the right to take reasonable steps to verify your identity or payment information in connection with processing your order.

If we do not process or cancel an order, we will either not charge you or, if payment has already been collected, refund the applicable amount in accordance with our policies and applicable law.

Without limiting the foregoing, and subject to applicable law, the Company reserves the right to:

revoke or withdraw a stated offer;
correct errors, inaccuracies, or omissions; and
make changes to prices, content, promotional offers, product descriptions or specifications, or other information.

Such changes may be made without prior notice where permitted by applicable law, including after an order has been submitted or acknowledged, except where prohibited by law.

Product and Service Descriptions

The Company attempts to provide accurate descriptions of products and services on the Company Sites.

However, to the extent permitted by applicable law, the Company does not warrant that all descriptions, images, specifications, prices, or other content are accurate, complete, reliable, current, or error-free.

If a product or service offered on the Company Sites is materially different from its description, you may be entitled to a return, refund, replacement, or other remedy in accordance with our applicable policies and applicable law.

The Company Sites may offer a quick-view feature for certain products.

This feature allows you to view certain product and price information and add products to your cart without opening the full product page.

The quick-view and “add to cart” features are provided for convenience only.

The applicable product page may contain more detailed information regarding the product, its features, specifications, source, and pricing.

Pricing Information

The Company strives to provide accurate pricing information regarding products and services available on the Company Sites.

However, pricing errors may occasionally occur.

Subject to applicable law, the Company reserves the right not to process or to cancel an order placed for a product or service whose price was incorrectly displayed as a result of an error.

If this occurs after payment has been collected, the applicable payment will be refunded.

Where appropriate, the Company may notify you by email.

The Company also reserves the right, subject to applicable law, to correct errors in stated prices or other pricing information.

Product and Service Availability

The Company Sites may contain information regarding the availability of merchandise.

Such information is intended to provide an estimate of whether an item is expected to be available for shipment after an order is placed.

The estimated delivery time to your destination address may be approximately 30 days or less after successful payment, but actual delivery times may vary depending on product availability, destination, weather conditions, customs processing, carrier transit times, logistics disruptions, and other circumstances beyond our reasonable control.

The Company cannot guarantee that an item displayed as “in stock” will ship immediately because inventory levels may change.

In some cases, a product or service may appear to be available when an order is submitted but become unavailable before the order is processed.

If this occurs, the Company may notify you by email and cancel the unavailable product or service from your order.

Where payment has already been collected for a cancelled item, the applicable amount will be refunded in accordance with our policies and applicable law.

Specific Additional Disclaimers and Obligations

In addition to the general disclaimers contained in the Terms of Use, and subject to rights that cannot lawfully be excluded, products and services purchased through the Site:

(a) may not include manufacturer warranties, even if the same or similar product is available elsewhere with such a warranty;

(b) may not include certain service or support options;

(c) may not include product manuals, instructions, or safety warnings in your native language or in all languages used in your destination jurisdiction;

(d) may not have been specifically designed according to all standards, specifications, certification requirements, or labeling requirements applicable in your jurisdiction; and

(e) may use voltage, plugs, electrical standards, or other specifications that differ from those applicable in your destination jurisdiction and may therefore require an adapter or converter.

You are responsible for reviewing relevant product information before purchasing and for determining whether the product is suitable for your intended use and may lawfully be imported into and used in your jurisdiction.

Nothing in this section excludes or restricts rights or remedies that cannot lawfully be excluded or restricted under applicable consumer protection laws.

Taxes, Duties and Customs

You are responsible for taxes, customs duties, import charges, fees, or other governmental charges imposed by the jurisdiction to which products are shipped, except where such amounts are expressly included in the price paid at checkout.

This may include, without limitation, applicable sales taxes, use taxes, value-added taxes, import duties, tariffs, or customs charges.

Where consumption taxes, customs duties, or similar charges are expressly collected by us at checkout, such amounts will be included in your payment.

Where such charges are not collected by us, you may be required to pay them directly to the relevant authorities, customs agency, carrier, or other applicable party.

GOVERNING LAW

These Terms of Purchase, the Terms of Service, and any separate agreements whereby we provide you with products or services shall, to the extent permitted by applicable law, be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region of the People's Republic of China.

Nothing in these Terms is intended to deprive a consumer of any mandatory rights or protections available under applicable law that cannot lawfully be waived or excluded.
